Paralysis/Spinal Cord Injuries
Spinal cord injuries resulting from accidents are life-changing events for most victims and their families. Serious spinal cord injuries require a lifetime of therapy, medical treatment, and rehabilitation. Unfortunately, many people never fully recover from spinal cord injuries, particularly where the injury results in paralysis or quadriplegia. Because of the extensive medical care required for victims of spinal cord injuries, astronomical medical costs accompany most spinal cord injury cases. Securing the necessary financial resources to insure appropriate care is an important legal step for victims of spinal cord accidents.

Birth Injuries
Expecting and delivering a new baby should be a happy time and a time free from medical complications. However, when negligence by medical professionals results in injuries or death to a newborn, medical malpractice has occurred.
|
|
|
“Birth injuries” can occur at any point during pregnancy, during delivery, and during newborn care immediately following delivery. Improper handling of a baby during delivery can result in loss of oxygen causing brain damage, cerebral palsy, Erbspalsy, mental retardation, seizures. We know that children with cerebral palsy require special treatment, occupational therapy, medication and attendant care. If you are a parent with a special needs child, there are many resources which may be able to provide you help. If your baby suffered injuries before, during or after birth, our staff may be able to help. While cerebral palsy can be caused by things other than birth trauma (including bacterial or viral infections) only experts trained in assessing the management of labor and delivery can determine if your child’s injury was related to birth injury.

Catastrophic Medical Malpractice
Medical malpractice is a negligent or careless act committed by a doctor or other health care provider. If an injury to a patient occurs while a medical provider is performing below the standard of care required in diagnosing or treating medical conditions, the patient may have a cause of action for medical malpractice against that medical provider. The "standard of care" is the accepted standard recognized by other health care providers in the same field of medicine under similar circumstances. The following list is provided to illustrate what is meant by the term "below the standard of care:"
|
|
- Failing to diagnose a tumor while reading an x-ray
- Puncturing a nearby organ or tissue during surgery
- Improperly performing surgery or a procedure
- Failing to remove a sponge or other article after surgery
- Failing to properly deliver a baby, resulting in cerebral palsy or other brain damage
- Failing to care properly for the mother before or during delivery
- Failing to order necessary and appropriate medical tests
- Failing to diagnose a condition in time to treat it properly
- Failing to refer a case to a medical specialist
- Prescribing incorrect medication
- Incorrect diagnosis that results in a failure to treat a medical condition
- Negligent caring for an elderly patient
- Failing to properly administer anesthesia
- Emergency room negligence
Who can be held accountable?
- Physicians and Nurses
- Hospitals and Clinics
- Nursing Homes
- Chiropractors
- HMOs and PPOs
- Home Health Providers
- Dentists
- Pharmacists
- Rehabilitation Facilities
Not every bad result is due to medical negligence. The fact is, the majority of health care providers do good work. That being said, mistakes are still made by medical providers who injure thousands of people each year and adversely affect them and their families forever. If you have undergone any form of medical treatment which, you believe, resulted in either an injury to you or a worsening of your condition, you may be a victim of medical malpractice and need to obtain qualified legal counsel immediately.
Medical malpractice law is extremely complicated and there are legal issues, such as statutes of limitation, which could affect your ability to recover. It is critical that you contact us as soon as possible for a free consultation about your rights.
